Guidance on paragraph 135 of the HTA’s Code of Practice on the Human Transplantation (Wales) Act 2013 - excluded relevant material

Following the passage of the Human Transplantation (Excluded Relevant Material) (Wales) Regulations 2015 on 6 October 2015, the HTA has produced the following guidance to supplement the information provided in paragraph 135 of the HTA’s Code of Practice on the Human Transplantation (Wales) Act 2013.

Consent cannot be deemed for tissue specified as excluded relevant material, a subset of which is excluded composite tissue. Consent must be obtained for the removal of excluded relevant material for the purposes of a transplantation activity (described in paragraph 173 of the Code).

Consent cannot be deemed for removal of all or part of these excluded composite tissues:

  1. Brain
  2. Spinal cord
  3. Face
  4. Nose
  5. Mouth
  6. Arm
  7. Upper arm
  8. Forearm
  9. Hand
  10. Finger
  11. Leg
  12. Thigh
  13. Lower leg
  14. Foot
  15. Toe

Consent cannot be deemed for removal of all or part of these excluded relevant materials:

  1. Ovary
  2. Uterus
  3. Penis
  4. Testicle
  5. Fetus
  6. Placenta
  7. Umbilical cord
  8. Embryo (inside the body)

The whole or part of any of the tissue listed below that forms part of any “excluded composite tissues listed above is not considered to be excluded relevant material, and therefore, consent for its removal can be deemed. For example, consent could be deemed for the removal of muscle or bone from the hand (the hand being specified as an excluded composite tissue above) but the removal of a complete hand could not be deemed.

  3. Artery
  4. Bone
  5. Muscle
  6. Tendon
  7. Skin

Yn dilyn pasio Rheoliadau Trawsblannu Dynol (Deunydd Perthnasol a Eithrir) (Cymru) 2015 ar 6 Hydref 2015, mae’r Awdurdod Meinweoedd Dynol wedi cyhoeddi’r canllawiau canlynol i ategu’r wybodaeth a ddarperir ym mharagraff 135 Cod Ymarfer yr Awdurdod ar gyfer Deddf Trawsblannu Dynol (Cymru) 2013.

Ni ellir tybio cydsyniad ar gyfer meinweoedd a nodir fel deunydd perthnasol a eithrir, sy’n cynnwys yr is-set meinweoedd cyfansawdd a eithrir. Rhaid cael cydsyniad i dynnu deunydd perthnasol a eithrir at ddibenion gweithgaredd trawsblannu (fel a ddisgrifir ym mharagraff 173 y Cod).

Nid ystyrir mai deunydd perthnasol a eithrir yw’r cyfan neu ran o unrhyw un o’r meinweoedd a restrir isod sy’n ffurfio rhan o unrhyw ‘feinweoedd cyfansawdd a eithrir’ a restrir uchod, ac felly, mae cydsyniad i’w thynnu’n gallu cael ei dybio.
